Hereinafter "Tof-Box", "we", or "the Publisher".
PART I — GENERAL TERMS OF USE AND SALE (TOU-TOS)
Article 1 — Purpose and scope
These General Terms of Use and Sale (hereinafter "TOU-TOS") set out the terms and conditions under which Tof-Box makes its personal digital vault service available to its users, accessible via the website tof-box.app and via its native mobile applications available on the App Store (iOS) and the Google Play Store (Android) (hereinafter collectively the "Service").
They apply to any adult natural person, or any minor over 16 years of age acting with the authorisation of their legal representative, who creates an account and uses the Service (hereinafter the "User").
Creating an account and using the Service implies full, unreserved acceptance of these TOU-TOS, of the Acceptable Use Charter (accessible separately and accepted distinctly at registration), and of the Privacy Policy. A User who does not accept these documents must refrain from creating an account and using the Service.
Article 2 — Definitions
- Service: all features offered by Tof-Box, including the saving, organisation, sharing and management of the User's links, content, images, notes and digital documents, as well as the additional features described in Article 3.
- Account: the personal, secure space created by the User to access the Service.
- Content: any link, text, image, screenshot, note, loyalty card, business card or other data saved by the User in their Account.
- Vault: the User's personal storage space within the Service.
- Encrypted Vault: the optional storage mode described in Article 5, in which certain Content is encrypted on the User's device before transmission, such that Tof-Box has no technical access to its unencrypted content.
- Collaborative Folder or Project: a shared space enabling several Users to jointly contribute to the same set of Content.
- Native App: the iOS and Android applications enabling access to the Service from a mobile device.
Article 3 — Description of the Service
Tof-Box enables the User to:
- save and organise links, articles, videos, shopping ideas, loyalty cards and business cards within default categories and, depending on the subscribed plan, custom sub-categories;
- share certain Content, folders or their profile publicly or in a protected manner;
- invite other Users to collaborate within shared folders, within the limits specific to each subscription plan;
- optionally activate an Encrypted Vault for certain Content (see Article 5);
- benefit from additional features depending on the subscribed plan (AI-generated summaries, QR code generation, smart collections, personalised widgets, data export, etc.).
The Service is accessible via the website tof-box.app as well as via the Native Apps. Paid subscriptions may only be taken out, modified or cancelled via the website tof-box.app; the Native Apps do not offer any in-app purchase mechanism. This arrangement has no bearing on the User's rights as described herein.
Article 4 — Account creation and management
Registration requires a valid email address, or the use of third-party authentication via a Google account. The User undertakes to provide accurate information, to keep their login credentials confidential, and to immediately inform Tof-Box of any unauthorised use of their Account of which they become aware.
The Service is not intended for persons under 16 years of age. Tof-Box reserves the right to request proof of age and to suspend or delete any Account that appears to have been created by a person who has not reached this minimum age, without prejudice to the exercise, by the holder of parental authority, of the rights provided for in Article 11 hereof. Minors over 16 years of age using the Service benefit from the protective measures set out in Article 13.3 hereof.
Tof-Box reserves the right to suspend or terminate any Account in the event of fraudulent, abusive, illegal use, or use contrary to these TOU-TOS or to the Acceptable Use Charter, following prior notice unless urgency justified by the protection of the Service or of third parties requires otherwise.
Article 5 — End-to-end Encrypted Vault (optional feature)
The User may activate, on an optional basis and at any time from Settings, an enhanced encryption mode for all or part of their Content, identified within the app under the name "Private Vault". This mode relies on a secret phrase chosen by the User, from which an encryption key is derived exclusively on their device; this secret phrase and the key derived from it are never transmitted to or known by Tof-Box.
Content placed in the Encrypted Vault is encrypted before being sent to our servers, which only receive and store the encrypted version, unreadable as such.
Warning — irreversible loss. Owing precisely to this architecture, Tof-Box has no technical means of decrypting this Content, nor of helping the User recover their secret phrase if forgotten. Loss of the secret phrase, in the absence of a valid recovery key (see below), results in the permanent and irreversible loss of access to the Content concerned, for which Tof-Box cannot be held liable.
To limit this risk, the User has the option of generating a recovery key, displayed only once at the time of its generation, which it is the User's responsibility to keep in a safe place (printout, export, or any other means at their discretion). This recovery key allows access to the Encrypted Vault to be restored if the secret phrase is forgotten, as long as it has not been invalidated by a subsequent change to that phrase. It is the User's sole responsibility to keep it safe; Tof-Box keeps no copy of it and cannot regenerate it.
Article 6 — Subscription plans
The Service is offered under the following plans, the detailed content and current pricing of which are displayed on the page tof-box.app/billing:
6.1 Free plan (free of charge)
- Up to 50 saved items in total.
- 4 main categories, with no possibility of creating custom sub-categories, except for two sub-categories within the "My shopping ideas" category and two sub-categories within the "My favourite links" category (i.e. a maximum of four custom sub-categories in total), intended to allow the User to test this feature before subscribing to a paid plan.
- Up to one business card and up to three loyalty cards.
- Black-and-white sharing QR codes, with watermark.
- Basic public sharing.
- PIN code lock on items and folders.
- Non-personalised contextual advertising, displayed only after the User's explicit consent (see Cookie Policy).
- No smart collections, no personal widgets, no AI-generated summaries, no collaborative folders.
6.2 Standard plan (paid)
- Up to 500 saved items.
- Unlimited custom sub-categories.
- AI-generated summaries (Claude Haiku, provided by Anthropic).
- Custom QR codes, without watermark.
- Smart collections.
- Unlimited loyalty and business cards.
- Up to 4 personal widgets on the dashboard.
- No advertising.
- No collaborative folders.
- A "Family" variant is available, allowing a paying account holder to invite up to 3 additional members, each benefiting from the advantages of the Standard plan on their own personal space, with access to a shared "Family" folder.
6.3 Premium plan (paid)
- Unlimited saved items.
- All Standard plan features.
- Unlimited personal widgets.
- Collaborative folders (up to 500 members per folder).
- Search for similar articles when a link becomes inaccessible.
- Full export of personal data (JSON and CSV formats).
- Priority customer support.
- A "Family" variant is available under the same conditions as those described in Article 6.2.
The Encrypted Vault described in Article 5 is accessible from all plans, including Free.
Current prices, expressed inclusive of all taxes and available in euros (EUR) or US dollars (USD) depending on the User's location, are displayed transparently on the page tof-box.app/billing prior to any subscription. Tof-Box reserves the right to change these prices for the future; any price change will only apply to Users already subscribed as of their next renewal, following at least 30 days' prior notice.
Article 7 — Payment and billing terms
7.1 Payment provider
Payments are processed entirely by Stripe, a third-party payment services provider certified PCI-DSS, acting in particular via its facilitated payment service Stripe Link. Tof-Box does not at any time collect or retain the User's card data; only an opaque customer identifier, specific to Stripe, is retained. Stripe also acts as a provider for the collection and remittance of applicable value-added tax, as part of its "Managed Payments" offering.
7.2 Nature of the subscription
The Standard and Premium plans constitute automatically renewing subscriptions. By subscribing, the User authorises Tof-Box, through Stripe, to charge their payment method:
- immediately, for the amount displayed at the time of subscription (this amount may benefit from a one-off discount, applicable to the first invoice only, in the event of a valid promotional code or referral benefit — see Article 9);
- then, at each due date (monthly or annually depending on the chosen frequency), for the full price then in effect for the subscribed plan, automatically and without further action by the User, until cancellation under the conditions of Article 10.
This information is presented to the User, clearly and unambiguously, prior to any subscription, by means of a dedicated checkbox whose acceptance is a condition for validating the payment.
7.3 Payment failure
In the event of a failed payment at a renewal due date, Tof-Box informs the User by email and grants a three-day grace period to update their payment method, before the Account is downgraded to the Free plan.
Article 8 — Right of withdrawal
In accordance with applicable consumer protection law, a User acting as a consumer has a 14-calendar-day withdrawal period from the date of their first subscription to a paid plan, to withdraw without having to justify their decision.
This right is exercised:
- exclusively on the occasion of the first subscription to a paid plan; it does not reopen on the occasion of an automatic renewal, nor on the occasion of a plan change (upgrade) during the subscription, the reference date remaining that of the initial subscription;
- by means of the dedicated feature accessible from Settings → My subscription, as long as the 14-day period has not elapsed.
Where this right is exercised within the allotted period, the User is refunded pro rata for the unused portion of the period already paid for, calculated on the basis of the ratio between the time remaining until the next due date and the total duration of the billed period. The refund entails the immediate downgrade of the Account to the Free plan and, where applicable, the immediate loss of access to paid features.
The User is informed, prior to any subscription, of the existence of this right and of how to exercise it, by means of the consent checkbox mentioned in Article 7.2.
Article 9 — Cancellation by the User
The User may cancel their subscription at any time, free of charge and without justification, from Settings → My subscription. Cancellation takes effect at the end of the current, already-paid period: access to the features of the subscribed plan is maintained until that date, after which the Account is automatically downgraded to the Free plan. Cancellation outside the withdrawal period described in Article 8 does not give rise to any refund, even partial, of the current period.
Article 10 — Promotional codes and referral programme
Tof-Box may offer, at its discretion, promotional codes in the form of a percentage discount applicable to the first invoice only, a number of free days or months, or free access granted on an exceptional basis. The precise terms of each code (validity period, number of uses, eligibility conditions) are communicated to the User at the time it is entered.
Each User has a personal referral code. When a referee first subscribes to an annual paid plan through this code, the referrer receives one free month, automatically applied as a one-off discount on their next annual invoice. This benefit is personal, non-transferable, non-monetisable, and does not give rise to a refund in the event of early cancellation of the referrer's subscription.
Article 11 — Account deletion and right to erasure
The User may, at any time and without justification, request the permanent deletion of their Account from Settings → Delete my account, subject to confirmation of their password (except for Accounts created exclusively via Google authentication) and explicit confirmation of their intent.
This deletion results in the erasure of all Content and personal data associated with the Account, with the exception of:
- billing data, retained for a period of 10 years in accordance with accounting and tax obligations applicable in Belgium;
- any content reports retained for legal compliance purposes (notably under the European Digital Services Act).
If the User has an active paid subscription at the time of deletion, it is immediately cancelled with Stripe, with no refund of the current period beyond what is provided for in Article 8.
Article 12 — Intellectual property
Content saved by the User remains their exclusive property. Tof-Box claims no ownership right over the User's Content and only uses it to the strict extent necessary to provide the Service.
The "Tof-Box" trademark, its logo, its interface, its source code and all the graphic and textual elements that make it up are the exclusive property of Boom Boom SRL and are protected by copyright and trademark law. Any unauthorised reproduction or use is prohibited.
Article 13 — Liability, content moderation and protection of minors
13.1 Availability of the Service
Tof-Box implements reasonable means to ensure the availability, security and proper functioning of the Service, without being able to guarantee uninterrupted availability. Tof-Box cannot be held liable for a service interruption, data loss or damage resulting from a case of force majeure, a cyberattack, or the failure of a third-party provider mentioned in Article 4 of the Privacy Policy.
13.2 User Content and limited liability regime
The User is solely responsible for the Content they save, publish or share through the Service. In accordance with the limited liability regime applicable to hosting service providers under Regulation (EU) 2022/2065 ("Digital Services Act"), Tof-Box is not liable for Content stored at the User's request, as long as it does not have actual knowledge of its manifestly illegal nature. As soon as Content is reported to it or brought to its attention as manifestly illegal, infringing, defamatory or infringing the rights of a third party, Tof-Box acts promptly to remove it or disable access to it, without notice if the severity so warrants.
13.3 Protection of minors
As the Service remains accessible to minors over 16 years of age under the conditions of Article 4, Tof-Box implements the minor protection measures required by Article 28 of Regulation (EU) 2022/2065, notably with regard to default privacy settings and the absence of targeted advertising profiling based on data of users identified as minors.
Article 14 — Amendment of these TOU-TOS
Tof-Box may amend these TOU-TOS at any time, notably to take into account legal, regulatory or functional developments. Any substantial amendment is notified to the User by email or by a notification within the Service, at least 30 days before it takes effect. Continued use of the Service after that date constitutes acceptance of the amended TOU-TOS.
Article 15 — Language of these terms
These TOU-TOS, the Privacy Policy and the Cookie Policy are drafted in French and then faithfully translated into English, Dutch, German, Spanish and Portuguese. Each of these versions constitutes a version in its own right, enforceable against the User who contracted in the language in question. In the event of a discrepancy in interpretation between the language versions, the French version shall prevail, Belgian law being the law applicable hereto.
Article 16 — Applicable law and dispute resolution
These TOU-TOS are governed by Belgian law, without prejudice to any mandatory consumer protection provisions applicable in the country of habitual residence of a User acting as a consumer.
Any dispute relating to the formation, performance or interpretation hereof shall, failing amicable resolution, be submitted to the courts of the judicial district of Brabant Wallon (seated in Nivelles, Belgium), competent by virtue of the registered office of Boom Boom SRL.
However, in accordance with Regulation (EU) No 1215/2012, known as "Brussels I bis", any User acting as a consumer and residing in another Member State of the European Union retains the mandatory right to bring proceedings against Tof-Box either before the Belgian courts designated above, or before the courts of the Member State in whose territory they are domiciled, at their choice; conversely, Tof-Box may only bring proceedings against such a User before the courts of the Member State of their own domicile.
Without prejudice to the foregoing, any consumer User residing in the European Union may also make use of the European online dispute resolution platform for consumer disputes (https://ec.europa.eu/consumers/odr).
